Defects and maintenance of the leased property

Disputes often arise over who is responsible for repairs and maintenance of the property.

Under Swiss law, the landlord is responsible for maintaining the property in a condition suitable for its intended use and must bear the cost of necessary repairs and maintenance work. This includes remedying defects that affect the proper use of the premises.

The tenant, however, must cover the cost of small cleaning and repair tasks considered part of normal upkeep (so-called minor maintenance).

The tenant must also allow access for repair or inspection work announced in advance.
