TENANCY LAW
Subletting in Switzerland
A tenant may sublet all or part of the property with the landlord’s consent.
The landlord can refuse consent only if the tenant withholds information about the sublease, if the sublease terms are unfair compared to the main lease, or if the sublease causes significant disadvantage to the landlord.
The tenant remains responsible for ensuring that the subtenant uses the property in accordance with the original lease conditions.
Disputes often arise over who is responsible for repairs.
Landlords must maintain the property in good condition, while tenants cover only minor wear-and-tear repairs.
Issues include delays in repairs, disagreement over what constitutes a “minor repair,” and claims for rent reduction due to defects.
